EatForkful Terms and Conditions

Please read these Terms and Conditions ("Terms") carefully before using EatForkful. By creating an account or using the service, you agree to be bound by these Terms. If you do not agree, do not use EatForkful.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you and EatForkful ("we", "us", or "our"). They apply to your use of the EatForkful website and all related features, tools, and services (collectively, the "Service"). We may update these Terms from time to time. Continued use of the Service after updates constitutes acceptance of the revised Terms. We will notify you of material changes via email at least 14 days in advance.

2. Eligibility

You must be at least 13 years of age (or 16 in the EU/EEA) to use EatForkful.
By using the Service, you represent that you meet the applicable age requirement.
If you are using EatForkful on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

We do not knowingly allow accounts for users under the minimum age. If we discover an underage account, we will terminate it and delete associated data.

3. Accounts

3.1 Registration

You must create an account to use most features of EatForkful. You agree to provide accurate, current, and complete information during registration and to keep it up to date.

3.2 Account Security

You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. Notify us immediately at legal@eatforkful.com if you suspect unauthorized access.

3.3 One Account Per Person

Each account is for a single individual. You may not share your account credentials or allow others to use your account.

3.4 Account Termination

You may delete your account at any time from your account settings. We may suspend or terminate your account if you violate these Terms. See Section 12 for details on what happens to your data upon termination.

4. Free Service & Future Paid Plans

EatForkful is currently offered free of charge. We intend to introduce paid plans in the future, which may include expanded AI features, higher usage limits, or other premium capabilities.

When paid plans are introduced:

We will give existing users advance notice before any features become paid-only.
Free tier users will retain access to a defined set of core features at no charge.
Pricing, billing cycles, and refund terms will be published at the time paid plans launch and will be incorporated into these Terms.

AI-powered features may be subject to usage limits or usage-based billing. Where applicable, limits and charges will be clearly displayed before you use such features.

5. AI-Powered Features

5.1 Nature of AI Outputs

Nutritional information, recipe suggestions, pantry analysis, and other outputs generated by EatForkful's AI features are provided for informational and convenience purposes only. They do not constitute medical, dietary, clinical, or professional advice. Always consult a qualified health professional before making significant dietary changes.

5.2 Accuracy

AI-generated outputs may contain errors or inaccuracies. Nutritional data, ingredient lists, and recipe information should be verified independently, particularly if you have food allergies, intolerances, or medical dietary requirements. We are not liable for decisions made based on AI outputs.

5.3 Receipt & Image Parsing

When you upload a receipt or image for pantry parsing, you grant us permission to process that image using AI tools to extract food and product information. Parsed results are approximate and may not be complete or accurate. Do not upload receipts containing sensitive personal or financial information beyond what is necessary for pantry tracking.

5.4 Usage Limits

AI features may be subject to usage limits to ensure fair access for all users. We reserve the right to throttle or restrict AI feature access if usage exceeds reasonable limits or if abuse is detected.

6. User Content

6.1 Your Content

You may submit, upload, or share content through EatForkful, including food logs, pantry data, recipes, photos, comments, and other materials ("User Content"). You retain ownership of your User Content.

6.2 License to EatForkful

By submitting User Content, you grant EatForkful a non-exclusive, worldwide, royalty-free license to store, display, process, and use your User Content solely to provide and improve the Service. We do not claim ownership of your content and will not use it for advertising or sell it to third parties.

6.3 Shared & Public Content

EatForkful includes features that allow you to share content with other users (such as recipes or food entries). When you share content:

You understand that shared content may be visible to other EatForkful users.
You are responsible for ensuring you have the right to share any content you post.
You can manage the visibility of your content through your account settings.
We are not responsible for how other users interact with or use content you choose to share.

6.4 Content Standards

You agree not to post User Content that:

Is false, misleading, or fraudulent
Infringes any third-party copyright, trademark, or other intellectual property right
Contains hate speech, harassment, threats, or discriminatory content
Is sexually explicit or pornographic
Promotes dangerous dieting practices, eating disorders, or self-harm
Contains spam, unsolicited advertising, or malicious code
Violates any applicable law or regulation

6.5 Content Removal

We reserve the right to remove any User Content that violates these Terms or that we determine, at our sole discretion, to be harmful, objectionable, or in violation of our community standards. We will endeavor to notify you when content is removed, except where prohibited by law.

7. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose or in violation of these Terms
Attempt to gain unauthorized access to any part of the Service or other users' accounts
Scrape, crawl, or extract data from the Service using automated means without our express written permission
Reverse engineer, decompile, or attempt to extract the source code of the Service
Use the Service to transmit malware, viruses, or other malicious software
Impersonate another person or entity
Interfere with or disrupt the integrity or performance of the Service
Use AI features in a way intended to circumvent usage limits or abuse the system
Resell or sublicense access to the Service without our prior written consent

8. Intellectual Property

8.1 EatForkful's IP

The EatForkful name, logo, design, software, and all content we create (excluding User Content) are owned by or licensed to us and are protected by intellectual property laws. You may not copy, reproduce, modify, or distribute our intellectual property without our express written consent.

8.2 Feedback

If you provide feedback, suggestions, or ideas about EatForkful, you grant us the right to use that feedback without restriction or compensation to you. We appreciate the input and use it to improve the Service.

8.3 Third-Party Content

Nutritional data may be sourced from third-party databases such as the USDA FoodData Central. Such data is used in accordance with applicable licenses and is provided as-is without warranty of accuracy or completeness.

9. Third-Party Services

EatForkful integrates with third-party services including Stripe for payment processing and AI providers for intelligent features. Your use of these integrations is also subject to the relevant third party's terms and privacy policies. We are not responsible for the practices of third-party services.

The Service may contain links to third-party websites or resources. These links are provided for convenience only. We do not endorse and are not responsible for the content, accuracy, or practices of any third-party sites.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, EATFORKFUL DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

Warranties of merchantability, fitness for a particular purpose, or non-infringement
Warranties that the Service will be uninterrupted, error-free, or secure
Warranties regarding the accuracy, completeness, or reliability of nutritional data or AI outputs

Use of EatForkful for health or dietary management is at your own risk. We are a tracking and convenience tool, not a medical service.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, EATFORKFUL AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING BUT NOT LIMITED TO:

Loss of data or content
Decisions made based on nutritional or AI-generated information
Unauthorized access to your account
Any interruption or cessation of the Service

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100 USD.

Some jurisdictions do not allow certain liability exclusions or limitations. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

12. Termination

12.1 By You

You may stop using the Service and delete your account at any time through your account settings. Upon deletion, your personal data will be handled as described in our Privacy Policy.

12.2 By Us

We may suspend or terminate your access to EatForkful at any time if:

You violate these Terms or our content standards
We are required to do so by law
Your account shows signs of fraudulent or abusive activity

Where possible, we will give you notice and an opportunity to address the issue before termination. In cases of serious violations, we may terminate access immediately without notice.

12.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and dispute resolution) shall continue to apply.

13. Governing Law & Disputes

These Terms are governed by the laws of the State of New York, United States, without regard to its conflict of law principles.

For users in the EU/EEA: Nothing in these Terms limits your rights under applicable consumer protection or data protection laws in your country of residence.

We encourage you to contact us at legal@eatforkful.com to resolve any dispute informally before pursuing formal legal action. Most concerns can be resolved quickly this way.

14. General Provisions

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and EatForkful regarding the Service.

Severability: If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force.

Waiver: Our failure to enforce any right or provision of these Terms is not a waiver of that right.

Assignment: You may not assign your rights under these Terms without our consent. We may assign our rights in connection with a merger, acquisition, or sale of assets.

Language: These Terms are written in English. Any translations are provided for convenience only. In the event of a conflict, the English version controls.
